Terms and conditions

1. Scope of Application
These General Terms and Conditions of Sale (hereinafter “GTC”) apply to all legal transactions concluded directly with Zollinger Bio Sàrl (hereinafter “Zollinger Bio”), regardless of the order or purchase channel: online shop www.zollinger.bio, telephone, post or on-site purchase. They do not apply to purchases made through third-party platforms or reseller partners, which are governed by the conditions of those partners. Relations with reseller partners are subject to separate specific agreements.
Zollinger Bio reserves the right to amend these GTC at any time. The version in force at the time of the order applies to that order and cannot be unilaterally modified.
These GTC are drafted in French. In the event of translation into another language, the French version shall prevail.
2. Information
2.1 Products and Prices
Product images in advertising, brochures and the online shop are for illustration purposes only and are non-binding.
All selling prices published in the online shop are final prices and include all taxes applicable in Switzerland (including VAT).
Zollinger Bio reserves the right to modify the prices of products and services offered at any time. The price displayed in the online shop at the time of the order is binding for the conclusion of the contract.
Shipping costs within Switzerland:
- Orders for seeds and accessories via the online shop: CHF 4.90 (standard) or CHF 9.95 (priority).
- Seedling orders: CHF 9.95 per order. Free from CHF 90.— purchase value.
These rates may be adjusted at any time.
Orders from abroad:
Orders from abroad are only possible via the online shop, in the countries available during the ordering process. Effective shipping costs are displayed at the time of the order. The customer is responsible for customs clearance and bears all additional taxes and duties.
2.2 Availability and Delivery Times
Zollinger Bio places great importance on displaying the most current and accurate availability and delivery time information in the online shop. However, delays may occur due to production or delivery issues. All information relating to availability and delivery times is indicative and may be modified at any time.
3. Conclusion of Contract
The contract is concluded with Zollinger Bio as soon as the customer places an order in the online shop, by telephone or by e-mail.
The automatically generated order confirmation e-mail confirms receipt of the order but does not constitute a guarantee of delivery. It merely informs the customer that the online shop has received the order, subject to product availability and the accuracy of the stated price.
4. Delivery Times
Zollinger Bio endeavours to deliver all goods as quickly as possible, generally within 1 to 2 working days. Longer delays are not excluded, particularly during periods of high seasonal demand.
5. Delivery
Goods are shipped via Swiss Post or Planzer, depending on the type of order and the options available at checkout.
6. Customer’s Duty to Inspect
The customer is required to check delivered products immediately upon receipt for accuracy, completeness and functionality.
Any errors or damage must be reported to Zollinger Bio within 10 calendar days of receiving the products, via the form available at www.zollinger.bio/helpdesk/service-client-1 or by e-mail at info@zollinger.bio. If the parcel is damaged upon receipt, we kindly ask you to illustrate your claim with photographs.
If the error is attributable to Zollinger Bio, the product concerned will be exchanged free of charge as quickly as possible.
7. Warranty
We do our utmost to provide you with quality seeds. They are subject to systematic germination tests under organic open-field conditions.
No returns or exchanges are accepted. In the event of a delivery error attributable to Zollinger Bio, the product will be exchanged free of charge as quickly as possible.
8. Payment
Zollinger Bio accepts various payment methods, displayed during the ordering process. In the case of payment by invoice, the payment term is 21 days from receipt. The invoice is sent by e-mail and available in the customer account.
Ordered products remain the property of Zollinger Bio until full payment has been received.
In the event of total or partial non-payment within the stipulated period, all outstanding amounts become immediately due. Zollinger Bio may suspend current orders.
Reminder fees:
- 2nd reminder: CHF 20.—
- 3rd reminder: CHF 50.—
In the event of unsuccessful reminders, the claim may be assigned to a debt collection agency. Effective annual interest of up to 15% on the invoice amount, due from the payment deadline, may then be charged in addition.
9. Order Modification or Cancellation
Orders are binding on the customer for the receipt of the products and services. Zollinger Bio may, at its sole discretion, accept subsequent modifications or cancellations and charge a fee of up to 50% of the cancelled order amount, or the costs actually incurred if these are higher.
10. Zollinger Bio Membership
Zollinger Bio offers a paid membership (hereinafter “Membership”) providing access to exclusive services and benefits depending on the tier subscribed to.
10.1 Nature of the Membership Contract
The Membership is available in a monthly or annual version. It is automatically renewed at each due date — monthly or annually — according to the model subscribed to. The period already started is due in full, with no pro-rata refund.
10.2 Included Services
The services included in each tier are described on the dedicated page of the online shop at the time of subscription. Zollinger Bio reserves the right to modify them with 30 days’ notice by e-mail. The customer may cancel their Membership free of charge within this period.
10.3 Billing
The Membership fee is automatically charged at each due date — monthly or annually depending on the model chosen — to the customer’s registered payment method. In the event of a failed payment, Zollinger Bio reserves the right to suspend services until the outstanding amount is settled.
10.4 Cancellation
Le client peut résilier son Abonnement à tout moment sur demande (par téléphone, par e-mail ou par courrier). La période entamée est due dans son intégralité. Par exception, les demandes soumises durant le délai de garantie de trois mois donnent lieu à un remboursement intégral des frais de souscription, conformément aux conditions de la garantie "Satisfait ou remboursé". La résiliation prend effet à la fin de la période de facturation en cours — mensuelle ou annuelle selon le modèle souscrit.
11. Other Provisions
11.1 Data Protection
The Privacy Policy forms an integral part of these GTC and is accessible at www.zollinger.bio. By accepting these GTC, the customer also accepts the Privacy Policy. It complies with the requirements of the revised Federal Act on Data Protection (FADP), in force since 1 September 2023.
11.2 Severability
If any provision of these GTC is found to be null and void or ineffective, the remaining provisions shall remain fully applicable. The null provision shall be replaced by a valid provision as close as possible to the original intention of the parties.
11.3 Language and Applicable Law
These GTC are governed by Swiss law. In the event of translation into another language, the French version shall prevail. The place of jurisdiction for all proceedings is CH-1897 Les Evouettes.
